This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel appearing for the State.

The grievance of the Petitioner is that before filing of the show cause and before calling for the report, learned Sub-divisional Magistrate, Kuchinda has passed order restraining the Petitioner from constructing the boundary wall encroaching towards road. However in the meantime the Petitioner filed reply to the notice issued by the Sub-Divisional Magistrate.

Learned counsel appearing for the State on the other hand submits that since the Petitioner has filed the show cause let the show cause filed by the Petitioner be considered by the Sub-divisional Magistrate within a stipulated period.

Considering the aforesaid submissions, the present revision petition is disposed of with a direction to the Sub-divisional

// 2 // Magistrate, Kuchinda is hereby directed to consider and dispose of the show cause reply filed by the Petitioner as expeditiously as possible preferably within a period of three weeks from today. Further, it is directed that the learned Sub-divisional Magistrate, Kuchinda shall provide adequate opportunity of hearing to both the parties.

With the aforesaid observation the revision is disposed of. 7.
