With a prayer to quash the order dated 12th May, 2015 passed by the learned S.D.J.M., Paralakhemundi in G.R. Case No.15 of 2015 taking cognizance of the offences under Sections 454/380/34 of I.P.C. on filing of Charge-sheet No.22 dated 10th May, 2015 in connection with Serango P.S. Case No.2 of 2015, the petitioner filed this petition under Section 482 of Cr.P.C.

This Court vide order dated 25th July, 2017 issued notice to the Opposite parties and directed stay of further proceeding in G.R. Case No.15 of 2015 pending on the file of the learned S.D.J.M., Paralakhemudi.

At the time of hearing today, Mr. A.K. Kejriwal, learned counsel for the petitioner submitted that he has no instruction in the matter.

Mr. Ishwar Mohanty, learned Additional Standing Counsel appearing for the Opposite Party No.1-State submitted that by efflux of time the matter would have been proceeded substantially.

In view of the above situation, keeping this matter pending any further would not serve any fruitful purpose. Hence, this CRLMC is dismissed and interim order dated 25th July, 2017 passed by this Court stands vacated. 6.
A copy of this order be communicated to the Court concerned forthwith.
