This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The writ petition filed with the following prayer: "It is therefore prayed that your lordship would be graciously pleased to issue a Rule NISI in the nature of Mandamus directing the Opposite Parties to show cause as to why;
(i) The Departmental Proceeding No.574 dt.20.02.18 vide Annexure-1 will not be finalized within a specified period and will be quashed if not completed within the said period and (ii) Pass such other order/orders as deem fit and proper in the facts and circumstances of the case; and 4.
It is submitted by learned counsel for the Petitioner that Departmental Proceeding is pending since 2018 and the grievance of the Petitioner is for a direction to the Departmental Authority to conclude the same within a specific period of time.

Learned counsel for the State on the other hand submits that he has no objection if a direction is given to the Authority to consider and dispose of the said departmental proceeding within specific period of time.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Deputy Director of Agriculture, Kandhamal-Opposite Party No.2 to dispose of the departmental proceeding in accordance with law within a period of three months from the date of receipt of certified copy of this order. The Opposite Party No.2 shall dispose of the same by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

With the above direction, the writ petition stands disposed of.

Issue urgent certified copy of this order on proper application.
