This matter is taken up through hybrid mode.

It is submitted by the learned counsel for the petitioner that though the writ petition has been filed challenging the initiation of the disciplinary proceeding initiated by the Department, pendency of the writ petition has not helped in any manner as the said proceeding is still kept pending.

The learned Standing Counsel for the School and Mass Education Department referring to the counter affidavit, submits that the delay in disposal of the disciplinary proceeding, is attributable partly to the petitioner, for his lack of co-operation.

Learned counsel for the petitioner submits that he has always co-operated with the authority and tried for completion of the proceeding.

In view of the rival submissions, it may not be of any use to deal with the issue whether the petitioner has co-

// 2 // operated or not and the writ petition is disposed of with the following direction:

the authority shall do well to complete disciplinary proceeding of still pending within six months from the communication of the certified copy of this order by following due process of law. The petitioner shall also cooperate in completion of the proceeding as undertaken. 6.

Accordingly, the writ petition is disposed of. Urgent certified copy of the order be granted on proper application.
