This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

This writ petition has been filed with the following relief: "Under these circumstances, the petitioner most respectfully prays that this Hon'ble Court may graciously pleased to issue a writ of writs in the Nation of "Writ of Mandamus" directing the Opp. Parties more particularly the Administrator, Primary Agriculture Cooperative Society (PACS) Ltd., Nuapada (O.P. No.5) to consider and dispose of the appeal under Annexure-3 which is still pending before him since 08.12.2021 within a period of time that may be fixed by this Hon'ble Court."

Learned counsel for the Petitioner submits that a representation in this regard has been submitted to the Administrator,

// 2 // Nuapada PACS Ltd., Opposite Party No.5, which according to the Petitioner is still pending consideration.

Having heard learned counsel for the parties and considering the limited nature of request involved in this matter, the writ petition stands disposed of with a direction to the Administrator, Nuapada PACS Ltd., Opposite Party No.5 to consider the representation of the Petitioner vide Annexure-3, in accordance with law, if the same is still pending and take a lawful decision thereon, taking into account the grounds taken in the writ petition, within a period of two months from the date of communication of a certified copy of this order along with a copy of the writ petition by the Petitioner, giving opportunity of hearing to the Petitioner by passing a speaking and reasoned order thereon. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

With the above direction, the Writ Petition stands disposed of. 7.

Issue urgent certified copy as per rules.
