Heard Mr. S. Mishra, learned counsel for the petitioner, Mr. B.K. Parhi, learned Central Government Counsel, Mr. D. Nayak, learned Additional Government Advocate and Mr. S.B. Panda, learned counsel representing opposite party no.4. 2.

According to Mr. Mishra, the petitioner is aggrieved by non-payment of compensation in lieu of Acquisition of Right of User in his land under the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 visà-vis in Plot Nos. 25 & 27 falling within the Mouza-Biswali pertaining Hal Khata No. 26 in the District of Jagatsinghpur. 3.

Mr. Panda, learned counsel representing opposite party no.4 submits that if the petitioner has any grievance relating

// 2 // to payment of compensation, he should approach the competent authority in tune with Sub-Section 5 of Section 11 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 for reference of the matter to the jurisdictional District Judge for redressal of his grievances instead of approaching this Court.

In such background, Mr. Mishra, learned counsel for the petitioner wants to withdraw this writ petition as he wants to approach the appropriate authority under the above noted Act for redressal of the grievances of the petitioner. 5.

Considering such submission, the writ petition is disposed of as withdrawn.

Interim order granted earlier stands vacated. Urgent certified copy of this order be granted on proper application.
