This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Parjanga P.S. Case No.133 of 2022 corresponding to G.R. Case No. 127 of 2022 pending in the Court of learned J.M.F.C., Parjanga for commission of alleged offences under sections 294, 323, 506/34 of the Indian Penal Code.
Perused the F.I.R. annexed to the anticipatory bail application.
Considering the submission made by the learned counsel for the petitioner that the petitioner is a student and he is appearing at the +2 Science Annual
// 2 // Higher Secondary Examination, 2022 and there are no such materials to attract the ingredients of the offence under section 307 of the Indian Penal Code and that the two injured persons, namely, Amaresh Dalbehera and Arabinda Dalbehera have sustained simple injuries and after going through the injury reports filed by the learned counsel for the State, which are taken on record, the interim order dated 08.04.2022 passed in I.A. No. 373 of 2022 is made absolute. The ABLAPL is accordingly disposed of.
