This matter is taken up through Hybrid arrangement (video conferencing/physical mode). None appears on behalf of the informant.

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Baideswar P.S. Case No.145 of 2021 corresponding to G.R. Case No.503 of 2021 pending in the Court of learned S.D.J.M., Banki for alleged commission of offences under sections 498A/323/294/506/34 of the Indian Penal Code read with section 4 of the D.P. Act.

Perused the F.I.R.

// 2 // Learned counsel for the State on instruction submitted that in the meantime, on completion of investigation, charge sheet has been submitted under sections 498-A/323/294/506/406/34 of the Indian Penal Code read with section 4 of the D.P. Act. Considering the submissions made by the learned counsel for the petitioner that the petitioner is the husband of the informant and the case arises out of a matrimonial dispute and the offences are triable by Magistrate, the interim order dated 19.04.2022 is made absolute.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
