IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C). No.7220 of 2022 Sudhansu Kumar Dwibedi ....

Petitioner(s) Mr. N.Lenka, Advocate -versusState of Odisha & Ors.

....

Opp.Party(s) Mr.S.P.Panda, AGA .

CORAM:

JUSTICE BISWANATH RATH

ORDER

06.04.2022 1.

Heard learned counsel appearing for the parties. Order No.

2.

It is alleged that after the instrument under Annexure-7 (part) is produced for registration, the Sub-Registrar, Baripada, Mayurbhanj issuing notice at Annexure-8 directed the petitioner to appear along with connected documents at least within a period of seven days. Mr.Lenka, learned counsel appearing for the petitioner alleges that in spite of petitioner attending such call and providing all information along with documents, the Sub-Registrar is sitting tight over the matter and registration aspect is not completed.

3.

Considering the innocuous prayer and as the petitioner claims that he has already attended the call at Annexure-8, this Court finds there is no ground to further delay in taking decision on registerability of the instrument involved. Keeping this in view, this Court disposes of the writ petition with a direction to the Sub-Registrar, Baripadaopposite party no.3 to take a decision on registerability of the

// 2 // instrument within a period of ten days from the date of receipt of copy of this order by the petitioner and without insisting any other information and or any other document, as the petitioner has already provided all such information and documents.
