This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Chhendipada P.S. Case No.91 of 2021 corresponding to G.R. Case No.145 of 2021 pending in the Court of learned J.M.F.C., Chhendipada for alleged commission of offences under sections 341, 294, 354B, 307 of the Indian Penal Code. Considering the submission made by the learned counsel for the petitioner that the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and the submission made by the
// 2 // learned counsel for the State that the injured Monajini Sahoo has sustained simple injury and the fact that the petitioner has been granted interim protection since 23.03.2021 and there is no material that he has misutilized his liberty, the interim order dated 23.03.2021 is made absolute.
The ABLAPL is accordingly disposed of.
