Aswini Kumar Dhal v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No. 761 of 2022 Aswini Kumar Dhal ....
Petitioner Mr. Soubhagya S.Das, Advocate -VersusState of Odisha ....
Opposite Party Mr. Tapas Kumar Praharaj, SC
CORAM:
MR. JUSTICE R.K. PATTANAIK
ORDER
13.09.2022 Order No.
02.
1.
In view of the submission of the learned counsel for the petitioner that the petitioner has in the meantime been arrested on strength of warrant subsequently through proclamation issued by the court below, the CRLMC stands disposed of accordingly. 2.
It is further submitted that showing the petitioner as an absconder in the charge sheet and then issuance of proclamation in terms of Section 82 Cr.P.C. stands on the way of the petitioner and therefore to that extent necessary orders may be passed. However, the Court is not inclined to do so, in view of the fact that such an order passed by the learned court below is in accordance with law and is also not stigmatic since process is followed only to procure or compel one's attendance.
3.
Consequently, the CRLMC stands disposed of in the above terms.
(R.K. Pattanaik) Judge Kabita
