Learned counsel for the petitioner undertakes to remove the defect within three days.

Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to regularize the service of the petitioner as Trained Graduate Teacher with effect from 28.02.2004 as per Government Resolution under Annexure-4.

In course of hearing, learned counsel for the Petitioner states that highlighting the grievances, the Petitioner has made a representation to Opposite Party No.1 vide Annexure-23 and the same may be directed to be considered in terms of the ratio decided by this Court in the case of Harapriya Patra v. State of Orissa and others (WPC (OAC) No. 2709 of 2016), within a stipulated time to which learned Standing Counsel for School & Mass Education Department has no objection.

As agreed to by learned Counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.1 to consider the representation filed by the Petitioner vide Annexure-23 taking into consideration the judgment in the case of Harapriya Patra (supra), in accordance with law within a period of three months from the date of production of certified copy this order. 7.

Issue urgent certified copy as per rules.
