This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Nikirai P.S. Case No. 20 of 2021 corresponding to G.R. Case No.223 of 2021 pending in the Court of learned S.D.J.M., Kendrapara for the commission of the alleged offences punishable under sections 341, 323, 307, 294 and 506 of the Indian Penal Code.

Learned counsel for the State on verification of the case diary submits that one Sarbeswar Sahoo was sent for medical examination on police requisition and the said report indicates that he has sustained simple injuries.

// 2 // Considering the submissions made by the learned counsel for the respective parties, taking into account the submission of the learned counsel for the petitioner that the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and the fact that the petitioner has been granted interim protection since 24.03.2021 and there is no material that he has misutilized his liberty, the interim order dated 24.03.2021 is made absolute. The ABLAPL is accordingly disposed of.
