Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 27.01.2022 in connection with Berhampur Town P.S. Case No.09 of 2022 corresponding to G.R. Case No.84 of 2022 pending in the Court of learned S.D.J.M., Berhampur for the alleged commission of offence under Sections 419/420/423/465/466/467/471/474/120-B of IPC 4.

It is alleged that the petitioner entered into a conspiracy with other persons to falsely execute sale deed showing sale of a land to one Jayanti Jena.

Having regard to the fact that the petitioner is not named in the FIR and has been implicated only on the basis of the statement of one of the co-accused persons, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
