1. This matter is taken up through virtual mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 13th February, 2022 in connection with Padmapur P.S.

Case No.24/2022 corresponding to T.R. Case No.33/2022 pending in the court of learned Addl. Sessions Judge-cum-Special Judge, Gunupur for the alleged commission of the offence under Section 20 (a)(b)(i) of N.D.P.S. Act.

4. It is alleged that the Petitioner had cultivated cannabis plants over a Government land measuring six acres. However, in course of search, no one was found at the spot and basing on confidential inquiry, the Petitioner was entangled in the case.

5. Having regard to the submissions as above and particularly in absence of any independent material to conclusively show that the Petitioner had in fact cultivated the cannabis plants, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
