Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 29.06.2021 in connection with Sonepur P.S. Case No.158 of 2021 corresponding to G.R. Case No.7 of 2021 pending in the Court of learned Sessions Judgecum-Special Judge, Sonepur for the alleged commission of the offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act. 4.

As it appears, the petitioner was the driver of the vehicle in which the contraband weighing 39 kg 750 grams of ganja was allegedly recovered. The occupant of the vehicle is the owner. 5.

It is submitted that the petitioner being the driver has only followed the instructions of his employer, therefore, he cannot be blamed for his owner's fault.

Having regard to the submissions, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally

appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
