This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the Vigilance Department. This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Berhampur Vigilance P.S. Case No.03 of 2021 corresponding to Vigilance G.R. Case No.02 of 2021 pending in the Court of learned Special Judge, Vigilance, Berhampur for alleged commission of offences under section 13(2) read with sections 13(1)(b) and 12 of the Prevention of Corruption (Amendment) Act, 2018.

Learned counsel for the petitioner submitted that pursuant to the interim order dated 24.03.2021, the petitioner

// 2 // appeared before the Investigating Officer on the date fixed and cooperated with the investigation.

Mr. M.S. Rizvi, learned Addl. Standing Counsel for the Vigilance Department submits that the petitioner was granted interim protection as per order dated 24.03.2021 and he has cooperated with the investigation and appeared before the Investigating Officer on due notice.

Considering the submissions made by the learned counsel for the respective parties, since the petitioner has not flouted any terms and conditions of the interim order and cooperated with the investigation, the interim order dated 24.03.2021 is made absolute subject to the condition that the petitioner shall appear before the Investigating Officer as and when noticed and shall not try to tamper with the evidence. The prosecuting agency is at liberty to move the learned Court below for cancellation of bail in case the petitioner flouts any of the terms and conditions.

With the aforesaid observation, the ABLAPL is accordingly disposed of.
