Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The allegation against the petitioner is that he being the husband subjected his wife (deceased) to cruelty in connection with demand of dowry. Though it is stated that the petitioner and his wife lived happily for five years after their marriage, but owing to misunderstanding over a petty issue, she committed suicide.

The above submission is difficult to accept on the face of it as there is no reason for a woman to commit suicide over a trivial matter if she was otherwise happy in her life.

Having regard to the nature of accusations and the existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore, rejected. However, it is open to the petitioner to renew his prayer after examination of some material witnesses in the case.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
