This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.01.2022 in connection with Daringbadi P.S. Case No.27 of 2021 corresponding to S.T. Case No.07 of 2022 pending in the Court of learned District and Sessions Judge, Balliguda for the alleged commission of offence under Sections 120-B/121121-A/302/307/395/324/323/294/506/ 427 of IPC read with Section 16(1-b)/18/19/20/38/39 of UAP Act read with Section 25(1-b)/27 of Arms Act.

It is alleged that the petitioner is a Maoist sympathizer, who provides shelter, food and also instigates the local villagers to join Maoists. It is submitted that all the co-accused persons have already been released on bail. Moreover, some of the co-accused persons against whom trial had commenced have in the meantime been acquitted for lack of evidence.

Taking into consideration all the above facts as also the period of detention in custody, I am inclined to allow the prayer

for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
