The Petitioner having been implicated in connection with Khaira P.S. Case No.40 of 2020 corresponding to C.T. Case No.128 of 2020 pending on the file of learned J.M.F.C., Soro for alleged commission of offence under section 498-A/304-B/302/34 of the IPC read with section-4 of the DP Act, has filed this application under section-438 of the Cr.P.C. for his grant of anticipatory bail in the event of his arrest in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed and other surrounding circumstances; while being not inclined grant anticipatory bail to the Petitioner, this application is disposed of with the observation that when the occasion would so arise before the learned Court in seisin of the
// 2 // case to consider the prayer for grant of regular bail to the Petitioner, the same shall be considered on its own merit; further taking into account all such developments which have taken place in the meantime in their proper perspective and disposed of early in accordance with law, so as to enable the Petitioner to move the next higher forum early in case necessity so arises. 5.
The ABLAPL is accordingly disposed of.
Interim order passed on 05.05.2020 stands vacated. Issue urgent certified copy as per rules.
