1. Heard Mr. B.K. Parida-2, learned counsel for the Petitioner as well as Miss S. Mishra, learned A.S.C. for the State-Opposite Party.
2. The Petitioner is aggrieved upon the condition imposed by the learned Sessions Judge, Cuttack in Criminal Revision No.04 of 2022 regarding release of her vehicle.
3. It is submitted that the vehicle in question is a 15 years old Yamaha R-15 motor cycle and the learned Sessions Judge has directed to give cash security of Rs.30,000/- as one of the conditions for releasing the same. It is further submitted that the Petitioner is a poor woman and her son is the accused for commission of offences under Sections 392/411/34, I.P.C. As such, she has prayed to waive such condition of cash security.
4. After hearing learned A.S.C. for the State-Opposite Party and considering the approximate value of the property, the Petitioner is directed to furnish security in the shape of bank deposit for Rs.10,000/- in lieu of the condition of cash security of Rs.30,000/- as directed by the learned Sessions Judge. All other conditions of the learned Sessions Judge shall remain unaltered.
5. With the aforesaid modification in the direction of the learned Sessions Judge, Cuttack, the CRLMC is disposed of.
6. An urgent certified copy of this order be granted on proper application.
