This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Balianta P.S. Case No.17 of 2021 corresponding to G.R. Case No.42 of 2021 pending in the Court of learned J.M.F.C.(O), Bhubaneswar for alleged commission of offences under sections 420, 468, 471/34 of the Indian Penal Code.
Learned counsel for the petitioner submitted that the main accusation is against one Sangram Jena, who is stated to have received money to provide a plot to the informant and the said accused was
// 2 // taken into custody and has been released on bail by the learned 2nd Addl. Sessions Judge, Bhubaneswar, copy of the order is filed and taken on record. It is further submitted that in the bail order, it is clearly mentioned that the cheating amount has already been paid back to the informant.
Considering the submissions made by the learned counsel for the respective parties, the nature of accusation against the petitioner, release of the coaccused on bail and since the offences are triable by Magistrate the interim order dated 24.03.2021 is made absolute.
The ABLAPL is accordingly disposed of.
