This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Papermetla P.S. Case No.01 of 2021 corresponding to G.R. Case No.87 of 2021 pending in the Court of learned S.D.J.M., Malkangiri for alleged commission of offences under sections 419/420/406 of the Indian Penal Code. Perused the F.I.R.

Learned counsel for the State has produced the written instruction obtained from the Inspector in-charge of Papermetla police station, which indicates that the petitioner has taken a sum of Rs.45,000/- (rupees forty five thousand) from the informant.

// 2 // Considering the submissions made by the learned counsel for the respective parties, the nature of accusation against the petitioner, the interim order dated 24.03.2021 is made absolute subject to condition that the petitioner shall deposit a sum of Rs.45,000/- (rupees forty five thousand) before the learned S.D.J.M., Malkangiri by the end of April, 2022. If the petitioner fails to deposit the aforesaid amount within the said date, the learned Magistrate shall take immediate steps for arresting the petitioner.

The ABLAPL is accordingly disposed of.

A copy of the order be communicated to the learned Court below.

Urgent certified copy of this order be granted on proper application.
