Heard learned counsel appearing for the petitioner. Order No.

Since the impugned order has been passed taking note of nonprosecution of the application involved herein by the party involved, noting prevents the petitioner to file petition under Section 151 of the Code of Civil Procedure for recalling such order and contesting such application on merit. It is keeping this in view, this Court disposes of the Civil Miscellaneous Petition permitting the petitioner to file an application under Section 151 of the Code of Civil Procedure to recall such order within a period of seven days hence in such event the trial court shall do well in considering the application in accordance with law.
