This matter is taken up through hybrid mode.

Petitioner in this RPFAM seeks to assail the order dated 11th October, 2021 (Annexure-4) passed by learned Judge, Family Court, Balasore in Cr.P. No.8 of 2018, which was allowed ex parte directing him to pay a sum of Rs.10,000/- as maintenance per month to the Opposite Party.

In course of hearing, learned counsel for the Petitioner submits that interest of justice will be best served if the Petitioner files an application before the learned Judge, Family Court, Balasore under Section 126 (2) Cr.P.C. to set aside the ex parte order and prays for withdrawal of the RPFAM. 4.
In view of such submission, the RPFAM is disposed of as withdrawn.

Certified copy of Annexure-4 shall be returned to the Petitioner on being substituted with attested photocopy thereof. s.s.satapathy Issue urgent certified copy of the order on proper application.
