Heard learned counsel appearing for the parties. 3.

The dispute involves introduction of additional exhibits but, however, mark with objection. The impugned order only involves a petition at the instance of the defendant seeking time for cross examining the witnesses which being allowed, the case is posted to further date for cross examining by the defendant. For a scope for rebuttal evidence provided already to the defendant, this Court finds, there is no infirmity in the impugned order required to be interfere with. 4.

With this observation, the Civil Miscellaneous Petition stands disposed of.
