Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 07.02.2022 in connection with Aska P.S. Case No.71 of 2022 corresponding to G.R. Case No.164 of 2022 pending in the Court of learned J.M.F.C., Aska Jharsuguda for the alleged commission of offence under Sections 399/402 of IPC read with Section 4 & 5 of the E.S. Act and Section 25(1-B)(a) of the Arms Act.

It appears that the petitioner along with three other persons was attempting to commit dacoity from the jewelry shop in Aska Town. While they were apprehended, a pistol with live cartridge was recovered from the possession of the petitioner. 5.

However, considering the submissions, the period of detention in custody and the fact that the petitioner is a local resident under Aska Police Station, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to

impose including the condition that he shall appear before the IIC of Aska Police Station on every Monday at 10 a.m. till submission of final form.

BLAPL is accordingly disposed of.
