This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner.

The petitioner has filed this writ petition seeking direction to the opposite parties to consider the actual pipe supply period of two months i.e. October, 2008 & November, 2008 only for calculation of price variation amount to be paid to the petitioner instead of four months indicated in the bar chart and to pay to it its due amount of Rs.64,72,043.50 excluding taxes or Rs.75,53,404.60 including taxes based on the internal calculations initially done by the opposite party for actual pipes supplied period of two months, along with interest thereon @ 12% per annum from 26.12.2008 (Annexure-2) to till its realization. 4.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before the opposite party no.3- Chief General manager (P&C), IDCO, BBSR vide Annexure-8 of the brief, and the same may be directed to be disposed of within a stipulated time.

Considering the contentions raised by learned counsel for

the petitioner, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.3 to consider the representation filed by the petitioner vide Annexure-8 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.
