Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 27.10.2021 in connection with Basta P.S. Case No.230 of 2021 corresponding to C.T. Case No.519 of 2021 pending in the Court of learned J.M.F.C., Basta for the alleged commission of offence under Sections 498A/323/294/304-B/302/34 of IPC read with Section 4 of D.P. Act. 4.
The petitioner is the brother-in-law of the deceased, who committed suicide.

The prosecution allegation is that the husband and other family members of the deceased subjected her mental and physical torture, due to which she committed suicide. There is no specific allegation against the present petitioner. The mother-in-law and father-in-law have been released on bail as per orders passed by this Court in BLAPL No. 10293 of 2021 and BLAPL No. 621 of 2022 respectively. Another relation of the family, namely, Shibasankar Sur has also been released as per the order passed by this Court in BLAPL No. 10294 of 2021.

Taking into consideration all the above facts and the absence of any specific allegation against the present petitioner, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
