Tapu@ Tapas Kumar Giri v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No. 2519 of 2022 Tapu @ Tapas Kumar Giri ....
Petitioner Mr. J.K. Khuntia, Advocate - Versus - State of Odisha ....
Opposite Party Mr. P.K. Maharaj, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
05.04.2022 1.
This matter is taken up through hybrid mode.
Order No.
1.
2.
Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
3.
The petitioner is in custody since 27.10.2021 in connection with Basta P.S. Case No.230 of 2021 corresponding to C.T. Case No.519/2021 pending in the Court of learned J.M.F.C, Basta for the alleged commission of the offence under Sections 498-A/323/294/304B/302/34 of I.P.C. read with Section 4 of DP Act. 4.
The petitioner is the husband of the deceased, who committed suicide.
5.
The prosecution allegation is that the petitioner had illicit relationship with another lady, which was objected to by the deceased. Since the petitioner did not mend his ways and rather subjected the deceased to different kinds of mental and physical torture, she committed suicide.
6.
Considering the severity of allegations and the availability of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore rejected. 7.
BLAPL is rejected.
