This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Government Advocate.

The Petitioner has filed the present writ application with the following prayer:

"It is therefore, prayed that in the interest of justice, this Hon'ble Court may graciously be pleased to admit this writ application, issue Rule nisi, calling upon the opposite parties to show cause as to why the notification dated 15.12.2021 (Annexure-4) shall not be quashed declaring the same as illegal and arbitrary;

And as to why the Opposite Parties shall not be directed to consider the case of the Petitioner for the selection to the post of Managing director, Jamdiha LAMPCS Ltd. And if the Opposite Parties failed to show cause or show insufficient cause/irrelevant cause, than make the said rule nisi absolute;

And pass any other order/s, direction/s as may deem fit and proper in the facts and circumstances of the case." 4.

In course of hearing, learned counsel for the Petitioner states that the Petitioner may be permitted to file a fresh representation

// 2 // ventilating his grievance before the Deputy Registrar of Co-operative Societies, Baripada division, Opposite Party No.3, which may be considered within a stipulated time in accordance with law. Learned counsel for the State on the other hand submits that he has no objection if permission is granted to the Petitioner to file fresh representation before the Opposite Party No.3 and the same is considered and disposed of in accordance with law 5.

In view of the limited nature of grievance of the Petitioner, this Court disposes of the writ petition at the stage of admission granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.3 ventilating his grievance within a period of seven days. If such a representation is filed within the time stipulated, the same shall be considered and disposed of by the opposite party no.3 in accordance with law within a period of two months thereafter and the decision so taken on the representation of the Petitioner shall be communicated within two weeks thereafter.

With the aforesaid observation the writ application stands disposed of.

Issue urgent certified copy as per Rules.
