This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Learned counsel for the State on instruction submitted that no F.I.R. has yet been registered against the petitioner in Biswanathpur police station in the district of Kalahandi.

In view of such submission, since there is no apprehension of arrest of the petitioner, I am not inclined to entertain the application under section 438 of Cr.P.C. The petitioner is at liberty to seek appropriate remedy after the registration of the F.I.R.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
