Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 12.09.2019 in connection with Koraput Town P.S. Case No.213 of 2019 corresponding to C.T. Case No.33 of 2020 pending in the Court of learned Addl. Sessions Judge, Koraput for the alleged commission of offence under Section 302 of IPC.

It is alleged that the petitioner killed his mother over a petty matter. As per the FIR lodged by the father of the petitioner, he assaulted his mother as there was delay in cooking and also chased the informant threatening to assault him. On the next morning when the informant returned and went inside his house, he found his wife lying dead. In his statement recorded under Section 161 Cr.P.C. however, the informant appears to have improved his version by stating in a manner as if he had witnessed the occurrence, though such fact is not mentioned at all in the FIR.

Taking into consideration all the above facts and the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.
