This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Learned counsel for the State on instruction from the S.I. of Police, Nilgiri police station submitted that no first information report has yet been registered against the petitioner Siddharath S @ Sankar Roy.

In view of such submission, since there is no apprehension of arrest of the petitioner, I am not inclined to entertain the application under section 438 of Cr.P.C. The petitioner is at liberty to seek appropriate remedy after the registration of the F.I.R.

The ABLAPL is accordingly disposed of.
