This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

The present writ petition has been filed with a prayer to direct the Opposite Parties to regularize the service of the Petitioner as Class-IV employee and grant consequential service and financial benefits as due and admissible to the Petitioner. It is submitted by learned counsel for the Petitioner that similarly situated persons have been extended the benefits by order of the learned Tribunal as well as this Hon'ble Court. In support of his contention he cited the decision of this Hon'ble Court in Mochiram Behera vs. State of Odisha & Ors. in W.P.(C) No.10261 of 2020, wherein benefits has been granted to the similarly situated employees. 4.

Considering the submissions made, this Court directs the Petitioner to file a representation before the Secretary, Forest and Environment Department, Govt. of Odisha, Opposite Party No.1

// 2 // highlighting his grievance with the copies of the orders passed by the Orissa Administrative Tribunal as well as this Hon'ble Court within a period of two weeks from today along with certified copy of this order. In the event such representation is filed within the stipulated time, the same shall be considered by the Opposite Party No.1 within a period of two months thereafter and shall dispose of the same by passing a speaking and reasoned order. It is further made clear that the authorities shall examine whether similarly situated persons have been extended the benefits by virtue of order of the learned Tribunal as well as this Court. In the event, it is found that similarly situated persons have been extended the benefits, the same benefit shall also be extended to the Petitioner within a period of two months thereafter.

With the above direction, the Writ Petition stands disposed of.
