Heard Mr.D.Mishra, learned counsel for the petitioner and Mr.A.K.Nanda, learned Addl. Government Advocate. 3.

According to Mr.Mishra the petitioner has filed this writ petition being aggrieved by the order dated 31.8.2002 passed in W.L. Case No. 736 of 1970 whereby the Resumption proceeding instituted under Section 3-B of the Orissa Government Land Settlement Act, 1962 has been allowed and the land which was purchased by the petitioner from the original lessee has been directed to be recorded in the Government khata. 4.

Mr.Nanda, learned Addl. Government Advocate submits that the impugned order is appellable one under Section 7 of the Orissa Government Land Settlement Act, 1962 and instead of filing an appeal the petitioner has unnecessarily rushed to this Court.

In such background Mr.Mishra, learned counsel for the petitioner wants to withdraw the writ petition as he wants to approach the appellate authority as constituted under the above act for redressal of her grievances.

Considering such submissions, the writ petition is disposed of as withdrawn.

Urgent certified copy of the order be granted on proper application.
