CORAM:

JUSTICE K.R. MOHAPATRA

ORDER

Order No.

04.04.2022 1.

1.

This matter is taken up through hybrid mode.

2.

The Petitioner in this writ petition prays for a direction for early disposal of C.P. No. 76 of 2017 filed by the Petitioner under Section 13(1) of the Hindu Marriage Act, 1955, which is pending before learned Judge, Family Court, Bhubaneswar. 3.

It is submitted by Mr. Mahanty, learned counsel for the Petitioner that although the Petitioner has led evidence, but the matter is being adjourned to different dates for cross-examination. Due to non-cooperation of Opposite Party, the matter is being dragged for which the Petitioner is highly prejudiced. Hence, the Petitioner prays for a direction for the aforesaid relief. 4.

Taking into consideration the submission made by learned counsel for the Petitioner and volume of pendency of such nature of cases before learned Judge, Family Court, Bhubaneswar, I am not inclined to entertain the prayer made in this writ petition. However, the Petitioner, if so advised, may file an application for early disposal of C.P. No. 76 of 2017 stating the grounds therein

// 2 // and in that event, learned Judge, Family Court, Bhubaneswar may consider the same and proceed with the matter in accordance with law.

5.

With the aforesaid observation, this writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
