This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for modification of the order dated 05.05.2022.
Learned counsel for the petitioners submitted that while granting anticipatory bail to petitioners nos.3, 4, 5 and 7, the same was rejected so far as petitioners nos.1, 2 and 6 are concerned, namely, Daka Swain, Ranjan Parida and Nigamananda Swain
// 2 // respectively on the ground of submission made by the learned counsel for the State that they have got criminal antecedents. It is further submitted that the petitioners nos.1 and 2 have got no criminal antecedent and therefore, the order may be modified and those two petitioners may also be granted anticipatory bail.
Learned counsel for the State on verification of the case record fairly submits that the petitioners nos.1 and 2 have got no criminal antecedent.
In view of such submission, the order dated 05.05.2022 is modified to the extent that the petitioners nos.1 and 2, namely, Daka Swain and Ranjan Parida in the event of arrest shall also be released on bail furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties each for the like amount to the satisfaction of the arresting officer with further conditions that they shall make themselves available for interrogation by the I.O. as and when required and they shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to the Investigating Officer.
Violation of any of the above conditions shall entail cancellation of bail.
With this modification, the rest part of the order
// 3 // dated 05.05.2022 remains unaltered.
I.A. is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
