This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

This present writ petition has been filed by the Petitioner with the following relief:

"The Petitioner therefore prayed that this Hon'ble Court may graciously be pleased to admit this writ petition and direct the Opposite Parties to grant pensionary benefits along with other retirement benefits to the Petitioner and further be pleased to direct the Opposite Party No.3 to dispose of the representation filed by the Petitioner for grant of pensionary benefit along with other retirement benefits under Annexure-5 within a stipulated period." 4.

It is submitted by learned counsel for the petitioner that the representation of the Petitioner dated 28.06.2021 (Annexure-5) is pending before the Engineer-in-Chief, Rural Works Division-1, Odisha, Bhubaneswar, Opposite Party No.3, on which, no decision has been taken as yet. Accordingly, a prayer has been made to dispose of the said representation expeditiously.

Learned counsel for the State on the other hand submits that he has no objection, if a direction is given to the Authority to consider and dispose of the representation of the Petitioner within a stipulated period of time.

Considering the limited nature of grievance, this Court disposes of the writ petition at the stage of admission with a direction to the Engineer-in-Chief, Rural Works Division-1, Odisha, Bhubaneswar, Opposite Party No.3 to consider and dispose of the representation of the Petitioner dated 28.06.2021 (Annexure-5) within a period of two months from the date of production of certified copy of this order. Opposite Party No.3 is further directed to consider the representation in accordance with law and shall dispose of the same by passing a reasoned and speaking order after affording opportunity of hearing to the Petitioner. The decision so taken shall be communicated to the Petitioner within a period of two weeks thereafter.

With the above direction, the Writ Petition stands disposed of.
