This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as the learned counsel appearing for the State.

The Petitioner seeks a direction to the Opposite Parties to promote the Petitioner to the rank of Assistant Executive Engineer with all consequential benefits from the date when his juniors/batchmates were given promotion and grant RACP benefits with retrospective effect since 2013.

Learned counsel for the Petitioner submits that the Petitioner has filed a representation on 09.08.2021 under Annexure-6 before the Commissioner-cum-Secretary, Department of Agriculture & Farmers' Empowerment, Odisha, Opposite Party No.1 which is pending as of now. He further submits that a direction be issued to the Opposite Party No.1 to consider the representation of the Petitioner in accordance with law within a stipulated period of time.

Considering the submissions made, the writ application is disposed of with a direction to the Opposite Party No.1 to consider the representation of the Petitioner dated 09.08.2021 under Annexure-6 in accordance with law within a period of two months from the date of production of certified copy of this order. The Opposite Party No.1 is directed to consider and dispose of the representation of the Petitioner by passing a reasoned and speaking order in the light of the order dated 03.08.2021 passed by this Court in W.P.(C) No.21795 of 2021 (Dr.Sushama Barik-v.-State of Odisha and another) and the decision taken on the representation of the Petitioner shall be communicated to the Petitioner within two weeks thereafter.

So far as the grievance of the Petitioner with regard to RACP is concerned, it is open for the Petitioner to approach the authority by filing a fresh representation highlighting his grievance with regard to RACP. In the event a representation is filed, the same shall be considered by the authority within a period of two months from the date of filing of such representation. In the event the Petitioner is found to be entitled to get the same benefit, the same shall be disbursed in his favour within four weeks thereafter. 7.
With the aforesaid observation the writ application is disposed of.
