The Petitioner in this RPFAM seeks to assail the order dated 20th January, 2022 passed by learned Judge, Family Court, Balasore in I.A. No.25 of 2017 (arising out of C.P. No.357 of 2016), whereby he allowed an application under Section 24 of the Hindu Marriage Act, 1955 (for short 'the Act') directing him to pay maintenance @ Rs.10,000/- per month to the Opposite Party from the date of application, i.e. on 21st February, 2017. 3.

Mr. Rayatsingh, learned counsel for the Petitioner submits that the RPFAM is not maintainable against an order passed under Section 24 of the Act. Hence, by filing a memo dated 21st July, 2022 (Flag-10), he prays for withdrawal of RPFAM to file a CRLMP.

Accordingly, the RPFAM is disposed of as withdrawn.

Certified copy of Annexure-1 shall be returned to the learned counsel for the Petitioner on substitution of attested photocopy thereof.
