IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C). No. 7678 of 2022 Pravat Ranjan Patra ....
Petitioner(s) Mr.N.K.Jena, Advocate -versusState of Odisha & Ors.
....
Opposite Party(s) Mr.S.Ghose, AGA
CORAM:
JUSTICE BISWANATH RATH
ORDER
28.06.2022 1.
Heard learned counsel appearing for the parties. Order No.
2.
This writ petition involves the following prayer: "Under the above facts and circumstances, it is humbly prayed that the Hon'ble Court may graciously be pleased to admit the writ application, to issue notice to Opp. Parties and after hearing to allow the same by directing the Opp. Party No.2 and 3 to accept the land revenue from the petitioner from the year 2011-12; And to pass any other order(s) or direction(s) be deemed fit and proper;
And for this act of kindness the petitioner shall as in duty bound ever pray;"
3.
It is surprise to note that this matter has already been taken up by the Coordinate Bench twice on 19.04.2022 as well as on 04.05. 2022. Both the order-sheets disclosed Government Advocate was asked to seek instruction in the mater and or filing counter affidavit. Three months have been passed in the meantime and no counter is also coming. There is no instruction provided even to the Government Counsel. Considering the nature of relief sought for involving a direction for accepting land revenue from the petitioner from the year 2011-12 and as this Court finds through Annexure-3 that there has been
// 2 // receipt of land revenue up to the year 2010, this Court disposes of the writ petition directing the opposite party nos.2 and 3 to accept the rent revenue from the petitioner provided there is no legal impediment by way of any intervention in the right of the petitioner involved herein even including the property involved herein.
