Heard learned counsel for the Parties.

The Petitioner has the allegation that he has met with medical expenditure of Rs.3,55,085/- on account of his own suffering from heart disease and as taken treatment in the Care Hospital, Bhubaneswar, but there has been release of only a sum of Rs.1,00,000/-. Ventilating his grievance, it appears, the Petitioner has already made a request to the Deputy Director, Research, Quality Control (R & B) Division, O.P.3, vide Annexure-3 pending since 22.12.2021. In the event of pendency of such application, O.P.3 is directed to look into the grievance of the Petitioner and take decision, as appropriate within one and half months of service of copy of this order and also keeping in view the principle applies in
// 2 // case of reimbursement of medical head. While taking decision, the Authority concerned is directed to take into account the decision of the Hon'ble Supreme Court in Shiva Kant Jha vrs. Union of India reported in (2018) 16 SCC 187.
