.....
Petitioners Mr. P.K. Khuntia, Advocate Vs.
State of Orissa & Ors.
.....
Opposite parties State Counsel
CORAM:
DR. JUSTICE B.R. SARANGI MISS JUSTICE SAVITRI RATHO
ORDER
14.03.2022 Order No.
This matter is taken up through hybrid mode.
2.
Heard Mr. P.K. Khuntia, learned counsel for the petitioners and learned counsel for the State opposite parties. 3.
The petitioners have filed this writ petition challenging the order dated 18.04.2006 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.2931(C) of 2000 vide Annexure-5 directing the State Government to take a policy decision for regularization of the services of the NMR employees working in the Zoological Garden and thereafter to disburse their salary. 4.
It is contended by learned counsel for the petitioners that the petitioners are entitled to get the benefits much prior to the date of regularization by the State Govt., more particularly, their service conditions should be protected in view of the order passed by this Court from time to time. 5.
Learned counsel for the State-opposite parties contended that during pendency of the writ petition, the
State-opposite parties have formulated a scheme and extended the benefit of regularization to the petitioners w.e.f. 25.12.2012. Therefore, the writ petition has become infructuous.
6.
In view of the above, since the relief sought by the petitioners have been granted, the writ petition has become infructuous and accordingly, the same is disposed of as infructuous by efflux of time.
