Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 29.01.2022 in connection with Jaleswar P.S. Case No.32 of 2022 corresponding to Special Case No.27 of 2022 pending in the Court of learned Sessions Judge-cum-Special Judge, Balasore for the alleged commission of offence under Sections 341/294/186/332/353/307/34 of IPC read with Section 21(C)/29 of Arms Act.

As per the FIR, one Ismail Khan and his niece were present in front of their house carrying a plastic bag. The petitioner is said to have arrived with the intention of buying brown sugar. In course of search, brown sugar was recovered from the conscious possession of the said Ismail Khan and nothing was seized from the present petitioner.

Having regard to the fact and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the
trial Court on each date of posting of the case without fail. 6.
BLAPL is accordingly disposed of.
