Considering the nature of dispute, this Court finds, entertainability of counter claim can very well be agitated in the ultimate hearing of the counter claim also. In this view of the matter, this Court is not inclined to interfere with the impugned order. 3.

The Writ Petition stands dismissed. Interim order of this Court dated 23.7.2007 passed in Misc. Case No.6352 of 2007 stands vacated. Considering the suit is of the year, 1990, the trial court is directed to conclude the trial of the suit by the end of this year. 3.

The Writ Petition stands disposed of.
