This matter is taken up through Hybrid mode.

This writ petitioner has been filed for a direction to Tahasildar, Rajkanika-Opposite Party No.2 to implement the order dated 2nd November, 2016 (Annexure-1) passed by the Commissioner, Consolidation and Settlement, Odisha, Cuttack in Revision Petition No.293 of 2013.

Mr. Mishra, learned AGA along with Mr.Swayambhu Mishra, learned ASC on instruction submits that although on receipt of order under Annexure-1 the Tahasildar, Rajkanika initiated RP Misc. Case No.19 of 2017 on his board, but the same was not taken up after 16th January, 2018. Learned ASC submits that the Tahasildar, Rajkanika requires 3-4 months time to take a decision in RP Misc. Case No.19 of 2017. 4.
Mr. Nayak, learned counsel for the Petitioner submits that Tahasildar, Rajkanika may adjudicate the RP Misc Case No.19 of 2017 giving opportunity of hearing to the Petitioner.

In the facts and circumstances of the case, the writ petition is disposed of with a direction to the Tahasildar, Rajkanika-Opposite Party No.2 to take a decision in RP Misc. Case No.19 of 2017 as expeditiously as possible, preferably by 30th September, 2022 in accordance with law giving opportunity of hearing to the parties concerned. 6.
In order to facilitate early disposal of the RP Misc. Case No.19 of 2017, the Petitioner is directed to appear before the Tahasildar, Rajkanika on 23rd May, 2022 along with certified copy of this order to receive further instruction in the matter. 7.
With the aforesaid direction, the writ petition is disposed of.
Issue urgent certified copy of the order on proper application.
