2. Heard learned counsel for the Petitioner, learned Addl. Standing Counsel for the State and learned counsel for the informant.

3. The Petitioner is in custody since 17th September, 2021 in connection with Katarbaga P.S.

Case No.165/2021

// 2 // corresponding to G.R. Case No.3507/2021 pending in the court of learned S.D.J.M., Sambalpur for the alleged commission of the offence under Sections 147/148/307/3-2/149/201/212 of the I.P.C..

4. The prosecution case is that on the date of occurrence the Petitioner being associated with five other persons brutally assaulted the deceased causing several bodily injuries, which ultimately resulted in his death. Though the entire incident is allegedly to have been committed at the instance of Bhojaraj Pradhan, yet there is clear evidence, prima facie, regarding involvement of the Petitioner in the occurrence.

5. Considering the severity of the allegations and the manner of commission of the alleged offence, I am not inclined to allow the prayer for bail, which is, therefore, rejected.

6. It is open to the Petitioner to renew his prayer after examination of material witnesses during trial. (Sashikanta Mishra) AKB Judge
