This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned counsel for the State.

The present writ petition has been filed by the Petitioners seeking for a direction to the Opposite Parties to regularize the services of the Petitioners as per the letter dated 09.12.2020 under Annexure-6 keeping in view of their six years completion of service and further direct to grant antedated regularization to the Petitioners along with seniority and other service and financial benefits as per law within a specified time period.

It is submitted by learned counsel for the Petitioners that highlighting their grievance, the Petitioners have filed a representation before the Mission Director, National Health Mission, Bhubaneswar, Opposite Party No.2 under Annexure-8, on which, no decision has been taken as yet. Accordingly, a prayer has been made
// 2 // to direct the Opposite Party No.2 to dispose of the said representation expeditiously.

Learned counsel for the State on the other hand submits that he has no objection, if a direction is given to the Authority to consider and dispose of the representation of the Petitioners within a stipulated period of time.

Considering the limited nature of grievance, this Court disposes of the writ petition at the stage of admission with a direction to the Mission Director, National Health Mission, Bhubaneswar, Opposite Party No.2 to consider and dispose of the representation of the Petitioners dated 10.12.2021 under Annexure-8 within a period of two months from the date of production of certified copy of this order. Opposite Party No.2 is also directed to consider the representation of the Petitioners in accordance with law and shall dispose of the same by passing a reasoned and speaking order after affording opportunity of hearing to the Petitioners. The decision so taken shall be communicated to the Petitioners within a period of two weeks thereafter.

It is made clear that the Petitioners shall not be disengaged from service till a decision is taken on the representation of the Petitioners under Annexure-8.

With the above direction, the Writ Petition stands disposed of. 9.
Issue urgent certified copy as per rules.
