This matter is taken up by virtual/physical mode. 2.

The Petitioner is a defaulting borrower of term loan availed from the Karnataka Bank, Bhubaneswar Branch for a sum of Rs.1.00 crores.

The said loan account bearing No.1087001600086101 was declared as NPA since 30st October, 2020 and notices under Section 13(2) of the SARFAESI Act, 2002 was issued on 18th August, 2021 at Annexure-5, and subsequent notice dated 3rd December, 2021 also was issued under Section 13(4) of the SARFAESI Act, 2002 assuming symbolic possession of the mortgaged properties.

Challenge has been laid to the aforesaid two notices dated 18th August, 2021 and 3rd December, 2021. Further prayer was

// 2 // made for direction to settle the account under the prevailing OTS Policy.

At the time of hearing, counsel for the parties state that present writ petition has become infructuous, in view of the subsequent writ bearing W.P.(C) No. 14647 of 2022 filed by the Petitioner.
